This Rental Policy (“Policy”) governs the rental of audiovisual equipment and related services provided by Boomax AV Rental (“Company,” “we,” “us,” or “our”) to the renting customer (“you” or “your”). By booking or accepting delivery/pickup of equipment from us, you agree to this Policy.

1. Rental Period

• The rental period begins when you take possession of the equipment (whether by pickup or delivery) and ends when it is returned to us in good working condition.
• Late returns may be subject to additional daily rental charges. Failure to return equipment within 7 days after the scheduled return date may be considered theft and reported to authorities.

2. Reservations & Payment

• A deposit may be required to secure your rental. The deposit amount will depend on the value of the equipment and rental terms.
• Full payment is required before the start of the rental period.
• We accept cash, credit cards, and other payment methods at our discretion.
• Equipment is not reserved until payment or deposit is received and confirmed by us in writing.

3. Cancellations & Refunds

• Cancellations made at least 48 hours before the start of the rental period will receive a 50% refund.
• Cancellations made less than 48 hours before the start of the rental period may receive only a 25% refund or no refund, at our discretion.
• No refund will be given for unused rental time once equipment has been delivered or picked up.

4. Delivery, Pickup & Setup

• Delivery and pickup services are available for an additional fee. Charges vary based on distance and time requirements.
• All deliveries are made within a 3-hour window unless an exact delivery time is scheduled for an additional fee.
• You are responsible for ensuring safe access to the delivery or pickup location.
• If equipment is to be used outdoors, you must provide weather protection to prevent damage.

5. Equipment Use & Care

• You are responsible for the safe and proper use of the equipment during the rental period.
• Equipment must only be used for its intended purpose and in accordance with manufacturer instructions.
• Do not modify, open, or attempt repairs without our prior written consent.
• Equipment should be stored securely when not in use.

6. Damage, Loss, Theft & Cleaning Fees

• You are responsible for any damage, loss, or theft of the equipment during your rental period.
• All damages must be reported to us immediately.
• Repair or replacement costs will be charged to you. Replacement cost is based on the full retail value of the equipment.
• A cleaning or repacking fee may apply if equipment is returned dirty, wet, with damaged cases, or not properly packed.
• If a rental vehicle, trailer, or transport case is provided, it must be returned in the same condition as received, with fuel (if applicable) and interior cleaned. Additional charges may apply for failure to do so.
• We recommend that you secure insurance coverage for high-value rentals.

7. Liability & Indemnity

• We are not liable for any injury, loss, or damage caused by the use or misuse of our equipment or services.
• You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, or expenses arising from your use of the equipment.

8. Identification & Authorization

• We may require valid government-issued photo ID before releasing equipment.
• The person signing the rental agreement must be at least 18 years old and legally authorized to enter into the agreement.

9. Force Majeure

We are not responsible for delays or failure to provide equipment or services due to events beyond our control, including but not limited to weather, accidents, natural disasters, strikes, or power outages.

10. Governing Law

This Policy is governed by the laws of the State of New York. Any disputes will be resolved in the courts of Rockland County, New York.
